1. Fair use
U.S. fair-use analysis is case-specific and considers purpose and character, nature of the work, amount and substantiality, and market effect together. Other countries apply different quotation, parody, criticism or reporting exceptions. Qclip does not pre-clear a use as lawful.
2. User responsibility
Campaign owners must secure rights to source footage. Creators must stay within the brief and separately clear third-party music, footage, brands and personality rights.
3. Copyright notice
Submit a ticket using Copyright / fair use and include:
- Name and electronic signature of the owner or authorized agent
- Identification of the protected work
- Exact reported campaign, submission or URL
- Reliable contact information
- Good-faith statement that the use is not authorized
- Accuracy and authority statement
4. Counter notice and repeat infringement
A user who believes removal resulted from mistake or misidentification may submit a counter notice through the same channel. Qclip may hold content or payment while the process is reviewed. Repeat or clear infringement may result in suspension.
